Criminal Cases in the Chattooga County Courts
Chattooga County court records are split by jurisdiction. The Clerk of Superior and State Courts keeps the files for the county’s main trial courts. Superior Court handles felony prosecutions and has broad trial jurisdiction. State Court handles authorized misdemeanor and traffic matters. Each court file tracks the charge as filed, later changes to that charge, scheduled events, rulings, and the final result. A police narrative or jail booking cannot replace that file.
Limited courts keep separate records. Magistrate Court handles matters within its statutory power, including some warrant proceedings; its verified telephone is 706-857-0711. Probate Court, reached at 706-857-0709, keeps matters within its own authorized jurisdiction. Summerville, Trion, and other municipal courts retain city ordinance and municipal case material. Ask which court appears on the citation, warrant, bond paper, or hearing notice before searching.
PeachCourt Is Account Gated
PeachCourt is the online route documented for Chattooga Superior and State Court records. It requires an account, so a reader should not assume that every docket is visible without signing in or that every scanned paper can be opened online. The service is useful for locating an indexed matter and following public docket events. Older files, documents that were never scanned, and restricted material may still require help from the clerk.
Georgia E-Access helps identify participating court record services, but it is a directory rather than one consolidated statewide case database. That distinction matters. A no-result in one interface may mean the wrong court, a spelling mismatch, an old file, or a case outside that system.
How to Search Case Records
Use the narrowest reliable identifiers. PeachCourt’s live interface is account gated, so the fields below are a practical search-key guide, not a claim about its current screen labels. If the online route fails, provide the same details to the clerk by telephone, fax, or at the counter.
- Identify the court from a citation, charging paper, or hearing notice.
- Open PeachCourt and select the relevant Chattooga court after signing in.
- Search by full party name or case number, then narrow by filing year.
- Open the docket and compare charge, event, and disposition entries.
- Ask the clerk for the exact document or a certified copy when proof is needed.
| Search key | Type | Value | Use |
|---|---|---|---|
| Full name | Text | Best spelling known | Broad party search |
| Case number | Text | Exact if available | Direct file match |
| Filing year | Year | Approximate | Narrows common names |
| Court | Selection | Superior or State | Routes the query |
Chattooga Clerk Copy Requests
The clerk’s office is at 10035 Commerce Street, Summerville, Georgia 30747. The main number is 706-857-0706, and the documented fax is 706-857-0686. Call before traveling if the request involves an older file, a large record, or a certified copy. State what is needed rather than asking vaguely for “the whole file.” A useful request names the defendant, court, approximate year, and case number.

Confirm municipal matters with the city clerk.
Request a docket printout, accusation or indictment, disposition or judgment, sentence, or certified copy as separate items. Certification means the clerk attests that the copy matches the official court record. Research did not verify local certification prices, so obtain the current total from the clerk before authorizing work.
What the Case File Shows
A court file describes the prosecution after filing. It may reveal that the filed charge differs from the arresting officer’s initial allegation, or that a count was amended, dismissed, or resolved by plea or trial. Read entries in date order and locate the signed final order before drawing a conclusion.
| Case number | The court’s unique identifier for the filed matter. |
|---|---|
| Charging paper | An accusation or indictment stating the prosecuted counts. |
| Docket | A dated index of filings, settings, orders, and hearings. |
| Plea and verdict | The recorded plea or fact finder’s result. |
| Disposition | The final outcome for each count, including dismissal when applicable. |
| Sentence | The court’s terms after a conviction or plea. |
“Nolle prosequi” means the prosecutor chose not to continue a charge at that time. It is not the same as a guilty finding. A disposition should be read count by count because one case can contain several charges with different results.
Municipal Records Stay Local
Summerville Municipal Court expressly handles traffic violations, city ordinances, and parking violations. Its official page lists sessions on the second and fourth Tuesday at 5:30 p.m. at the Chattooga County Judicial Annex, 120 Cox Street, Suite C. The clerk office is at 170 Cox Street and uses 706-859-0912. SummervillePay is a citation-payment service, not a full criminal docket search.
For a Trion municipal matter, contact the town clerk or police route because research found no verified public municipal case portal. A city citation number may not match a later Superior or State Court case number. When conduct leads to a county prosecution, trace the city report to the county court file rather than assuming the municipal payment page holds the final disposition.
Stages of a Criminal Case
The docket grows as the case moves. The basic path is: Charges Filed → Arraignment → Pretrial → Plea or Trial → Disposition → Sentencing. Arraignment is the hearing where the accused is formally called on to answer the filed charge. Pretrial entries can include motions, notices, discovery disputes, and calendar settings. A plea or trial resolves liability, while the signed judgment and sentence state the legal outcome.
Not every case follows every step. Counts may be dismissed before trial, a plea can resolve the matter, and scheduling entries can change. A docket event labeled “disposed” should prompt a search for the linked judgment. If the online index does not expose that document, ask the clerk for the disposition and sentence by name.
Correcting a Chattooga Case Record
If a docket appears to show the wrong person, wrong outcome, or missing disposition, save the case number and identify the exact entry at issue. Compare the clerk’s certified judgment with the online display. Then contact the court clerk that maintains the file. The sheriff cannot change a judicial docket, and the prosecutor is not the record custodian.
A court correction and a Georgia criminal-history correction are different tasks. The Georgia Crime Information Center receives criminal-history data from contributing agencies. If the court file is right but a state history is wrong, use the official GCIC review or correction process and provide the certified final disposition when requested.
Access & Restrictions
Georgia court records are generally subject to public access, but access is not absolute. Sealed matters, restricted criminal-history data, protected personal identifiers, juvenile material, and records closed by law may not appear in a public search. O.C.G.A. §35-3-37 can restrict ordinary public dissemination of eligible criminal-history information without physically destroying every government record.
The Georgia Open Records Act provides another request path for public records held by an agency. Under O.C.G.A. §50-18-71, search, retrieval, and redaction labor may be charged after the first 15 minutes at the rate of the lowest-paid qualified employee. Paper copies are generally ten cents per letter or legal page, with actual media costs also allowed. Narrow dates and request electronic delivery where practical.
Use the right custodian: PeachCourt for an indexed starting point, the court clerk for the official file and certified copies, and GCIC for the separate statewide criminal-history product.
Federal Cases Use PACER
A federal prosecution is not filed in Chattooga County Superior Court. Use PACER for federal dockets and the U.S. District Court for the Northern District of Georgia for court information. PACER currently charges ten cents per page, usually caps a document at three dollars, and waives a quarter’s fees when the total is thirty dollars or less under its schedule.
This channel answers a different question from PeachCourt. Search PACER when the charging agency or paperwork identifies a United States case. Search the Chattooga clerk routes when Georgia filed the prosecution in a county court.
Note: A public defender or prosecutor may explain a case role, but neither replaces the clerk as custodian of the docket.
